Terms and Conditions

  1. The transaction involves the sale of cooked meals (the “Product”) from Hokkaido Ramen Philippines Inc. (the “Merchant”) to its clients (the “Client”).
  1. The Client can order from the Merchant through phone calls or text messages to ____________________________. The Client shall clearly identify the items and quantity that he is buying, and the preferred mode of completing the transaction – pickup, takeout or delivery. Takeout orders shall be made and paid in the restaurant.
  1. Client Information. The Merchant shall obtain the Client’s Name, Contact Number, and Delivery Address. The Client shall be responsible for the accuracy of the data provided to the Merchant. The Merchant shall not be liable for any delay in the performance of its obligations due to inaccurate data from the Client. By providing these information, the Client agrees to the Merchant’s Data Privacy Policy found in the Merchant’s website.
  1. The price shall be quoted before or upon order of the Client. Payment for Products up for delivery or pickup shall be via Metrobank deposit or GCash. Items for takeout may be paid in cash, through credit card, or <other modes of payment, if any> at the restaurant. Only paid orders shall be considered binding.
  1. Delivery Time. The Merchant shall inform the Client about the approximate time of delivery. The Merchant shall not be liable for any delays in delivery if the delay is due to force majeure or factors beyond the Merchant’s control.   
  1. Grace Period to Accept Delivery. The Client undertakes to receive the Products upon arrival of the delivery personnel. The Merchant’s delivery personnel or third party delivery service will exert reasonable efforts to effect the delivery for up to five (5) minutes upon arrival at the Client’s delivery address. Should the Client fail to receive the items, the delivery personnel will leave with the Products and the Client will have to pick the items up from the Merchant’s premises. In this instance, the Merchant shall not be liable for the deterioration or change in the quality of Products which were belatedly received by the Client.
  1. Mistakes in the Delivery. The Client has the right to refuse acceptance of wrong or incomplete items. The cost of the omitted/wrong items shall be refunded to the Client within 24 to 48 hours upon receipt of the account details where the refund should be made.
  1. Pickup Time. The Merchant shall inform the Client about the approximate time of pickup. The Client shall be at the predetermined location at the designated time to pick the Products up. Should the Client delay, the Merchant shall not be liable for the deterioration or change in the quality of Products belatedly received by the Client.
  1. Client Responsibility. The Client shall check the quantity, quality, and packaging of the Products upon receipt. The Client shall NOT accept any item with torn packaging from the delivery personnel.

    The Client acknowledges that once the Product is in his possession, the same should be immediately consumed. The Merchant shall not be liable for the quality of the Product should the Client fail to consume the same immediately.

    Should the Client have any issue regarding the transaction, the same shall be conveyed to the Merchant within 24 hours from receipt of the Products. Otherwise, any issue or claim shall be deemed waived.
  1. The Merchant shall provide in its website and on the packing list the possible allergens in the Products. The Merchant shall not be liable for any allergic reaction which occurs upon consumption of the Products.
  1. Personal Consumption. The Client warrants that the Products shall be for his immediate personal consumption and that the same shall not be sold to third parties. The Merchant does not allow the Client or third parties to use the trademark of the product. Any violation of the Merchant’s trademark shall be dealt with in accordance with the relevant laws.
  1. Senior Citizen or PWD Discount. Except for pre-contracted party packages or bulk orders, the Merchant honors Senior Citizen or PWD Discount in accordance with R.A. 7432 (as amended) and its Implementing Rules and Regulations. Upon ordering, the Client shall inform the Merchant of the intention to avail of a Senior Citizen or PWD Discount. Upon ordering, the Client shall provide a photo of the Senior Citizen/PWD ID and authorization letter (in the event that the Senior Citizen cannot be present during delivery or pick-up). These documents shall also be presented upon delivery for verification. The 20% discount shall be computed in accordance with the relevant laws. Clients are reminded that any abuse of this privilege may subject them to criminal and civil liabilities.
  1. Force Majeure. No Party shall be held liable for any failure or delay in the performance of obligations if the failure or delay is due to acts of God, force majeure, legislation, or any condition beyond the control of such party. The obligation shall be suspended for as long as the condition remains. The affected party shall inform the other about the cause of delay or failure. The affected party shall resume the performance of its obligations once the condition ends.
  1. Any civil or criminal case arising from this transaction shall be filed in the appropriate courts of Quezon City, to the exclusion of other venues.
